TERMS & CONDITIONS – BLUE SUEDE CRUISE 2027

The following Terms and Conditions (“Terms”) for BLUE SUEDE CRUISE (“Cruise”), together with the terms and conditions contained in the Carnival Cruise Line Ticket Contract (“Ticket Contract”), contain important contractual terms, conditions and limitations on your rights.

They constitute a legally binding contract between you and Cruising Country Pty Ltd (collectively referred to herein as “BLUE SUEDE CRUISE” or “BSC”), as well as Carnival Cruise Line (“Carnival”), or their respective officers, directors, employees, agents and contractors (collectively referred to herein as the “Released Parties”), with respect to the Cruise.

All guests must read, agree to and accept these Terms before booking their stateroom for the Cruise and should retain them for future reference.

All references to “Guest” shall have the same meaning as “Passenger” for the purposes of these Terms and shall include each person listed on a Cruise Ticket Contract.

Each Guest’s reservation for BLUE SUEDE CRUISE, acceptance and/or use of the Ticket Contract, embarkation on the Cruise and attendance at any BLUE SUEDE CRUISE event constitutes acceptance of and agreement to these Terms and the Ticket Contract.

 

ACCEPTANCE & AGREEMENT TO CARNIVAL CRUISE LINE TICKET CONTRACT

By making this reservation, or by acceptance and/or use of the Ticket Contract, each person named as a Guest, passenger or guest on the same reservation acknowledges that they have read and understood the terms, conditions and provisions of the Ticket Contract and agree to be bound by them.

In addition, by making this reservation or accepting and/or using the Ticket Contract, each person named as a Guest shall be deemed to have accepted and agreed to the additional Terms and Conditions set forth herein.

 

BLUE SUEDE CRUISE GROUP CHARTER & EXCLUSIVE EVENT ACCESS

Carnival Splendor has a capacity of more than 3,000 guests at double occupancy, with BLUE SUEDE CRUISE operating as an exclusive VIP group charter within the wider Carnival sailing. BLUE SUEDE CRUISE is NOT a full-ship charter.

BLUE SUEDE CRUISE is limited to guests booked within the official BLUE SUEDE CRUISE group allocation, which is capped at up to 500 cabins.

Persons who book the same Carnival Splendor sailing directly through Carnival Cruise Line, or through another travel provider outside the official BLUE SUEDE CRUISE group charter allocation, are booking the regular Carnival sailing and are not entitled to access BLUE SUEDE CRUISE artist performances, exclusive parties, venue takeovers, activities or other exclusive programming.

Only guests booked through the official BLUE SUEDE CRUISE allocation and holding the appropriate BLUE SUEDE CRUISE credentials/lanyard may enter BLUE SUEDE CRUISE performances and events.

Passengers booked outside the official BLUE SUEDE CRUISE allocation cannot subsequently purchase or upgrade to BLUE SUEDE CRUISE access onboard or prior to sailing, unless expressly authorised by Choose Your Cruise.

Admission to individual performances, activities and venues may be subject to venue capacity, scheduling, safety requirements and any ticketing, reservation or access system implemented for the event. BLUE SUEDE CRUISE admission does not guarantee seating at every individual performance, activity or event.

Artist line-up, scheduled performances, activities and events are subject to change, substitution or cancellation. No refund will be provided solely as a result of a change to an individual artist, performance, activity or event, except where otherwise required by Australian Consumer Law. Bookings are for the overall BLUE SUEDE CRUISE experience rather than any individual artist or performance.

 

 

BLUE SUEDE CRUISE GROUP CHARTER ACCESS

BLUE SUEDE CRUISE fare includes:

  • Carnival cruise accommodation in the selected cabin category

  • Standard Carnival Cruise Line inclusions

  • Access to BLUE SUEDE CRUISE-exclusive entertainment, subject to applicable capacity and access arrangements

  • Access to BLUE SUEDE CRUISE-exclusive parties and events

  • BLUE SUEDE CRUISE lanyard/credential

  • Applicable BLUE SUEDE CRUISE programming

Unless specifically advertised as included, the BLUE SUEDE CRUISE fare does not include:

  • Meet and greets

  • Artist photographs or autographs

  • Merchandise

  • Specialty dining

  • Beverages

  • Shore excursions

  • Premium activities i.e. Spa treatments

  • Reserved seating

  • VIP upgrades

 

BLUE SUEDE CRUISE CREDENTIALS

BLUE SUEDE CRUISE Carnival Sail & Sign card credentials/lanyards issued to guests are valid only for the registered Guest to whom they are issued and must not be transferred, shared, sold or provided to another person.

Guests may be required to present their BLUE SUEDE CRUISE Carnival Sail & Sign card  credential together with other identification to access exclusive performances, parties, activities and event areas.

Lost, stolen or damaged credentials must be reported to Guest Services/Choose Your Cruise as soon as possible.

Unauthorised use, duplication, transfer or sharing of BLUE SUEDE CRUISE credentials may result in the suspension or revocation of BLUE SUEDE CRUISE event privileges without refund.

 

CANCELLATION POLICY

Payment and cancellation terms for BLUE SUEDE CRUISE 2027 take precedence over Carnival’s standard booking payment and cancellation terms where applicable to the BLUE SUEDE CRUISE booking.

Except where a refund or other remedy is required by Australian Consumer Law, all reservations, deposits and payments are non-refundable where a Guest cancels or elects not to travel.

Due to the unique nature of this event, cancellation by a Guest will result in the forfeiture of payments made prior to the cancellation notice, subject always to any rights or remedies available under Australian Consumer Law.

We strongly recommend purchasing appropriate travel insurance at the time of booking to protect against unforeseen circumstances that may require you to cancel your Cruise.

In the event that you must cancel your holiday, Choose Your Cruise must be notified in writing. The date on which Choose Your Cruise receives written notice will be considered the official cancellation date.

 

NO-SHOWS

No refunds will be provided for missed boarding, unused tickets or unused portions of the Cruise, except where otherwise required by law.

If a flight delay, transport disruption or other personal circumstance prevents you from boarding by the required departure time, you may be considered a no-show and no refund or credit will ordinarily be provided.

Likewise, a Guest’s decision not to travel due to personal concerns, travel advisories or other circumstances not resulting in cancellation of the Cruise will be treated as a Guest cancellation. No refund or credit will be provided for unused features or voluntary early departure, except where otherwise required by law.

 

LATE PAYMENTS

All bookings must be paid in accordance with the payment schedule outlined in the Guest’s invoice.

If a payment remains outstanding for more than seven (7) days past the due date, the booking may be subject to cancellation. Guests will be notified via email regarding overdue payments and the potential risk of cancellation.

If payment is not received within thirty (30) days of the original due date, the booking will be automatically cancelled without further notice.

For bookings paid by credit card, payments will be automatically processed on the dates specified in the payment schedule. In the event of a failed transaction, Guests will have three (3) business days to rectify the payment. Failure to do so may place the booking at risk of cancellation.

For bookings paid via Electronic Funds Transfer (EFT) or bank transfer, payment must be received within three (3) days of the booking date. If payment is not received within this timeframe, the booking will be automatically cancelled.

BOOKING CHANGES AND TRANSFERS

Guests may request correction of a genuine spelling error in their booking details at no additional cost.

Any name change requested on a booking will incur a fee, regardless of whether the original Lead Guest remains on the booking. A fee of $250.00 per person applies to each name change.

Name changes must be requested and completed no later than sixty (60) days prior to sailing.

Financial responsibility for the booking will remain with the original Lead Guest or primary contact recorded on the booking. Where a booking is transferred to new Guest(s), all payments already made will remain attached to the booking and will not be refunded by Choose Your Cruise.

Any reimbursement or financial arrangement between outgoing and incoming Guest(s) must be managed privately between those parties.

Where all Guests on a booking are replaced, the change will be considered a booking transfer rather than an individual name change. Name change fees apply to each Guest being replaced and a new booking number may be issued to reflect the transfer.

Fees for Name Changes and Booking Transfers

$250.00 per person, per name change.

All applicable fees must be paid in full at the time the change is requested.

Only the Lead Guest may request changes to a booking. All change requests must be submitted in writing no later than sixty (60) days prior to sailing.

Where a booking has been made through a travel agent, the travel agent may submit change requests to Choose Your Cruise on behalf of the Lead Guest.

Where all Guests on a booking are replaced, the incoming Lead Guest must accept the applicable Terms and Conditions and Carnival Cruise Line Ticket Contract before the booking transfer can be processed.

 

IMPORTANT INFORMATION

All booking changes and transfers are subject to availability.

Any fare difference, price increase, supplier charge, tax increase or additional cost arising from a booking change or transfer will be the responsibility of the Lead Guest and must be paid in full at the time the change is requested.

Choose Your Cruise reserves the right to refuse any booking change or transfer that does not comply with these Terms and Conditions, the Carnival Cruise Line Ticket Contract or the requirements of Choose Your Cruise and/or Carnival Cruise Line.

 

TRAVEL AGENTS

If you are a registered Travel Agent making a booking on behalf of a traveller or group of travellers, we require the details of all travellers, including names, dates of birth, email addresses and phone numbers.

Choose Your Cruise reserves the right to charge applicable name change fees and to pass on any name change fees imposed by suppliers or service providers where Guest details are supplied incorrectly or subsequently changed.

We require individual traveller contact details to ensure that important information regarding the booking and services can be communicated directly where necessary.

Where traveller details are not provided, the Travel Agent accepts responsibility for ensuring that all information supplied by Choose Your Cruise is communicated to the relevant travellers. Choose Your Cruise will not be responsible for losses or expenses arising solely from a Travel Agent’s failure to communicate information to a Guest, except to the extent otherwise required by law. This is particularly important in the event of last-minute schedule changes, operational updates or emergencies.

 

CANCELLATION OF BLUE SUEDE CRUISE OR CARNIVAL SAILING

In the unlikely event that BLUE SUEDE CRUISE, the underlying Carnival Cruise Line sailing, or a material part of the booked travel arrangements is cancelled prior to departure, Choose Your Cruise will notify affected Guests as soon as reasonably practicable.

Any requests for refund, credit, alternative arrangement or other remedy available will depend on the circumstances of the cancellation, amounts recoverable from Carnival Cruise Line and other relevant suppliers, and operate within the rights and remedies available to Guests under applicable law, including Australian Consumer Law.

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under Australian Consumer Law.

 

FORCE MAJEURE

Neither Party will be liable for any failure or delay in performing an obligation under this Agreement to the extent that the failure or delay is caused by circumstances beyond its reasonable control, including but not limited to acts of God, accident, riot, war, terrorist act, epidemic, pandemic, quarantine, outbreaks of infectious disease or other public health crisis, civil commotion, breakdown of communication facilities, natural catastrophe, governmental acts or omissions, changes in laws or regulations, national strikes, fire or explosion.

For the avoidance of doubt, Force Majeure shall not include financial distress, inability of either party to make a profit or avoid a financial loss, changes in market prices or conditions, or a party’s financial inability to perform its obligations.

Where a Force Majeure event affects services supplied by Carnival Cruise Line or another supplier, the applicable supplier terms and conditions may also apply, subject to any rights that cannot lawfully be excluded under Australian Consumer Law.

 

LIMITATION OF LIABILITY

Subject to Australian Law, where Choose Your Cruise acts as an agent for a supplier, Choose Your Cruise is not responsible for the independent acts or omissions of that supplier, including illness, personal injury, death, loss, delay or inconvenience caused directly by the supplier or other third party, except to the extent caused by the negligence or other legally actionable conduct of Choose Your Cruise.

Any claim arising from services supplied directly by a third-party travel or service provider may also be subject to that supplier’s applicable terms and conditions.

Choose Your Cruise is not liable for events outside its reasonable control except to the extent liability cannot lawfully be excluded.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by Australian Consumer Law that cannot lawfully be excluded, restricted or modified.

Carnival Cruise Line policies and cancellation conditions may be amended by Carnival from time to time.

 

INCLUSIONS AND GRATUITIES INFORMATION

WHAT’S INCLUDED IN THE HOLIDAY PRICE

  • BLUE SUEDE CRUISE group charter aboard Carnival Splendor

  • Standard meals in Carnival’s included dining venues

  • Applicable onboard gratuities included in the advertised fare

  • Access to BLUE SUEDE CRUISE headline shows and performances, subject to venue capacity, scheduling and applicable access arrangements

  • Port fees and government taxes

Costs are per adult in Australian dollars (AUD) and are based on twin-share accommodation.

Single travellers must pay 200% of the full twin-share price. 3 & 4th Passengers are priced at $995 per person.

Costs are subject to change prior to booking and confirmation. Where a booking has been confirmed, subsequent changes will be subject to these Terms, applicable supplier terms and Australian Consumer Law.

 

WHAT’S NOT INCLUDED IN THE HOLIDAY PRICE

  • Airfares

  • Passport or travel-document costs, where applicable

  • Travel insurance

  • Laundry

  • Phone calls

  • Beverages not otherwise included by Carnival

  • Items of a personal nature

  • Optional shore excursions

  • Specialty Spa, beauty & salon services

  • Onboard ‘Fun Shops’ shopping

  • Specialty dining and other chargeable onboard services

  • Other optional activities or purchases

The price does not cover costs or expenses, including return travel to your home, where you voluntarily leave the Cruise, leave due to illness, or are required to leave as a result of official action, except where otherwise required by law.

 

GOVERNING LAW

These booking conditions are governed by the laws in force in South Australia, Australia.

These booking conditions apply to the person making the booking and all other persons on whose behalf the booking is made.

The person making the booking must be at least eighteen (18) years of age and must be authorised to make the booking on behalf of all members of the travelling party.

The person making the booking must provide or make available a copy of these booking conditions to all other members of their travelling party.

 

ARTIST LINE-UP

BLUE SUEDE CRUISE intends to present the artist lineup in full as advertised. However, neither Choose Your Cruise, Artist Network Australia nor Carnival Cruise Line shall be liable for the failure of an artist or musician to appear or perform due to circumstances outside their reasonable control, subject always to applicable law.

Guests should be aware that while some headline artists may perform more than once, other headline artists may perform only once during the Cruise.

In the event that an advertised artist is unable to perform, BLUE SUEDE CRUISE/Choose Your Cruise may, where reasonably practicable, engage a replacement artist or alter, postpone, reschedule or cancel the affected performance or entertainment programming.

Artist line-up is correct at the time of publication and is subject to change.

A booking is for the overall BLUE SUEDE CRUISE experience and is not a ticket to see any particular individual artist. A change or cancellation involving an individual artist will not, by itself, entitle a Guest to a refund or credit, except where otherwise required by Australian Consumer Law.

 

BEHAVIOUR & REMOVAL OF BLUE SUEDE CRUISE PRIVILEGES

BLUE SUEDE CRUISE/Choose Your Cruise reserves the right to suspend or revoke a Guest’s BLUE SUEDE CRUISE event access and privileges, without refund, where a Guest engages in inappropriate, unsafe or disruptive conduct, including but not limited to:

  • Violence or threatening behaviour

  • Harassment

  • Excessive intoxication or disruptive behaviour

  • Abuse of staff, artists or other Guests

  • Unauthorised backstage or restricted-area access

  • Credential sharing, transfer or misuse

  • Interfering with performances or event operations

  • Breaches of Carnival Cruise Line safety requirements or policies

Revocation of BLUE SUEDE CRUISE event privileges is separate from, and does not determine, any further action Carnival Cruise Line may take in relation to a Guest’s continued carriage aboard the vessel.

 

HOST SHIP – CARNIVAL SPLENDOR

The advertised event vessel for BLUE SUEDE CRUISE 2027 is Carnival Splendor, owned and operated by Carnival Cruise Line.

The host ship is correct at the time of announcement and may be subject to change.

In the unlikely event that the advertised host ship is changed to an alternative vessel, all affected agents and booked Guests will be notified as soon as reasonably practicable.

Any rights or remedies arising from a material change to the booked travel arrangements remain subject to applicable law, including Australian Consumer Law.

 

RECORDING & PHOTOGRAPHY

Personal photography may be permitted subject to individual artist, venue and event rules.

Professional or commercial photography, unauthorised audio or video recording, livestreaming or other commercial recording of BLUE SUEDE CRUISE performances and activities is prohibited unless expressly authorised by Choose Your Cruise.

Guests acknowledge that official photography, filming and video recording may occur throughout BLUE SUEDE CRUISE and that their image or likeness may appear incidentally in event photography, video, media coverage or promotional material, subject to applicable law.

 

MERCHANDISE, AUTOGRAPHS & MEET AND GREETS

Artist merchandise, autograph opportunities, photographs, meet and greets and other artist interactions may be offered during BLUE SUEDE CRUISE at the discretion of Choose Your Cruise and/or the individual artist.

Unless specifically advertised as included in your booking, these experiences are not included or guaranteed as part of your Cruise fare.

Artist appearances, signing sessions and meet and greets may be subject to availability, capacity, scheduling and change or cancellation without notice.

Merchandise quantities, sizes and individual items are subject to availability and may sell out during the Cruise.

 

ACCESSIBILITY & SPECIAL REQUIREMENTS

BLUE SUEDE CRUISE and Choose Your Cruise are committed to providing an enjoyable and accessible experience for all Guests.

Guests requiring accessible accommodation, mobility assistance or other accessibility arrangements should notify Choose Your Cruise and Carnival Cruise Line of their requirements as early as possible prior to sailing.

Accessibility arrangements for accommodation, venues, performances and activities may be subject to the facilities, operational requirements and safety procedures of Carnival Splendor.

Reasonable efforts will be made to accommodate individual accessibility requirements. However, particular arrangements may be subject to Carnival Cruise Line’s policies, vessel capabilities, availability and applicable safety requirements.

 

PERFORMANCE SCHEDULES, VENUES & PROGRAMMING

All advertised performance times, venues, running orders, activities, parties and other BLUE SUEDE CRUISE programming are correct at the time of publication but are subject to change.

Choose Your Cruise reserves the right to alter performance times, venues, running orders and scheduled activities where reasonably necessary due to artist availability, operational requirements, safety considerations, Carnival Cruise Line requirements or circumstances outside our reasonable control.

Guests should refer to official BLUE SUEDE CRUISE communications and the onboard daily ‘Fun Times’ program for the most current schedule information.

Changes to individual performance times, venues, running orders or activities do not, by themselves, entitle Guests to a refund or credit, except where otherwise required by Australian Consumer Law.

 

ITINERARY & DEPARTURE PORT

The Cruise itinerary includes a scheduled stop at Tangalooma – Moreton Island.

The Cruise is scheduled to depart from the International Passenger Terminal at Circular Quay, Sydney, NSW. Address: Circular Quay West, The Rocks NSW 2000 (corner of Argyle and George streets)

The itinerary, port of call, embarkation port and disembarkation port are correct at the time of launch but may be subject to change due to weather, maritime, operational, safety, regulatory or other requirements.

In the event of an itinerary or port change, affected Guests and agents will be notified where reasonably practicable.

An itinerary or port change does not, by itself, entitle a Guest to a refund, credit or reimbursement, except where otherwise required by Australian Consumer Law.

 

CONTRACT

After Choose Your Cruise has received your required deposit or full payment, as applicable, and issued a confirmation invoice, a contract will exist in relation to the booked arrangements effective from the date shown on your confirmation.

Travel arrangements supplied by third-party suppliers, including Carnival Cruise Line, are also subject to the applicable supplier’s terms and conditions.

Each supplier is responsible for the travel products and services it directly provides, subject to applicable law.

 

DIETARY REQUIREMENTS

Special dietary or meal requirements will be handled on a request basis.

Guests should notify Choose Your Cruise, their travel agent and/or Carnival Cruise Line of dietary requirements as early as reasonably practicable.

While reasonable efforts will be made to accommodate special meal requests, fulfilment may depend on Carnival Cruise Line’s onboard facilities, availability and operational requirements.

Requests for particular main dining times are also subject to availability and cannot be guaranteed.

 

TRAVEL INSURANCE

It is strongly recommended that all Guests obtain appropriate comprehensive travel insurance at the time of booking.

Guests should ensure that their policy is appropriate for their individual circumstances and provides suitable cover for matters such as cancellation, illness, medical expenses, travel disruption, baggage and other relevant risks.

Guests are responsible for understanding the terms, conditions, exclusions and coverage of their chosen travel insurance policy.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by Australian Consumer Law that cannot lawfully be excluded, restricted or modified.

BLUE SUEDE CRUISE is a brand name of Cruising Country Pty Ltd and is operated for Cruising Country Pty Ltd.

BLUE SUEDE CRUISE is the intellectual property of Cruising Country Pty Ltd, ABN 32 159 918 323.

 

SMOKING POLICY

Carnival Cruise Line is dedicated to the safety of all guests and crew. Smoking is a fire and safety hazard aboard a ship and is therefore restricted to designated areas in accordance with Carnival Cruise Line policy.

All staterooms and suite accommodations, including outside balconies, are non-smoking.

Carnival’s smoking policy applies to cigarettes, cigars, pipes, vaporizers, electronic cigarettes, marijuana and other substances as specified by Carnival Cruise Line from time to time.

Guests are responsible for complying with Carnival Cruise Line’s current smoking and prohibited-substance policies.

Violations may result in charges being applied to the Guest’s Sail & Sign account, loss of onboard privileges and/or disembarkation in accordance with Carnival Cruise Line policy.

Guests who are disembarked as a result of a breach of Carnival Cruise Line policy may be responsible for associated travel and other expenses and may not be entitled to a refund for unused travel arrangements, subject to applicable law.

Carnival Cruise Line’s current smoking policy forms part of and/or should be read together with its Cruise Ticket Contract.

PREGNANCY POLICY

Guests acknowledge that medical facilities aboard a cruise ship and in ports of call may not provide the same specialised prenatal, diagnostic or emergency care available on land.

Pregnancy restrictions are determined by Carnival Cruise Line and may change from time to time.

Guests who are pregnant are responsible for reviewing and complying with Carnival Cruise Line’s current pregnancy policy before booking and again prior to sailing.

Where Carnival Cruise Line determines that a Guest is not eligible to sail due to the stage of pregnancy or applicable medical requirements, the Guest may be denied boarding or disembarked in accordance with Carnival Cruise Line’s applicable policies and Ticket Contract.

 

MINIMUM AGE REQUIREMENT

The minimum age to sail unaccompanied is determined by Carnival Cruise Line and may be subject to the itinerary, applicable laws and Carnival’s policies in effect at the time of sailing.

Guests are responsible for ensuring that their travelling party complies with Carnival Cruise Line’s current age, guardian and identification requirements.

Separate age restrictions may apply to alcohol consumption, gambling, entertainment venues and other onboard activities.

 

INFANT POLICY

Infant eligibility and minimum age requirements are determined by Carnival Cruise Line and may vary depending on the itinerary, number of consecutive sea days and other operational or regulatory requirements.

Guests travelling with infants are responsible for confirming Carnival Cruise Line’s current infant policy prior to booking and again prior to sailing.

Guests travelling with an infant who does not meet Carnival Cruise Line’s applicable minimum-age requirements may be denied boarding in accordance with Carnival Cruise Line’s Ticket Contract and policies.

Carnival Cruise Line may require proof of age for infants and children.

Additional restrictions may apply to children’s facilities, swimming pools, whirlpools, water attractions, childcare and other onboard services.

 

ADDITIONAL INFORMATION

Ship details, policies, facilities, images, descriptions, entertainment information and other published information are provided for general information and are correct to the best of our knowledge at the time of publication.

Carnival Cruise Line may modify ship facilities, policies, services, design, configuration or onboard offerings from time to time.

BLUE SUEDE CRUISE programming, event information and associated descriptions may also be updated where reasonably necessary.

Actual facilities, programming, design and configuration may vary from promotional images, descriptions or information previously published.
